The defendants-appellants (sellers) appeal from a judgment for the plaintiffs-respondents (buyers) in an action to reform a deed. Trial was to the court. The parties own adjoining lots on Sturgeon Bay and the dispute concerns the obligation of the sellers to convey one hundred thirty-three feet of shore line to the buyers. The shore line as determined by the court was approximately one hundred and fifteen feet and the court awarded damages for the additional eighteen feet of shore line rather than reform the deed to include the additional eighteen feet. Sellers appeal from the finding in favor of the buyers and the damage award. Buyers in turn, in a motion for review, claim that the court should award the additional lake front footage rather than damages.
